The Brombler service is provided by Devronium Applications SRL, tax identification number 296313636, registered office in Cumpăna commune, Constanța County, Romania, str. Canalului nr. 16 ("Devronium" or the "Provider").
The Provider holds ANCOM (LURN) license no. 225.1/24.03.2023.
These Terms of Usage (the "Terms") govern access to and use of the Brombler service (the "Service") by the legal entity that creates an account or otherwise uses the Service (the "Client" or "User"). By creating an account, accessing the API, or otherwise using the Service, the Client confirms that it has read, understood and accepts these Terms in full. If you do not agree with any of the provisions below, please do not use the Service.
1.Definitions
"Service" means the Brombler AI voice and IVR platform, including its telephony infrastructure, phone numbers, web application, API and any related functionality (automatic call routing, appointments, reminders, fault reporting, electronic document signing, reports, recordings and transcripts).
"Account" means the account created by the Client to access the Service. "Credentials" means the authentication details associated with an Account (username, password, API keys or similar).
2.Who may use the Service
The Service may only be used by legal entities. Individuals acting in a personal capacity, outside of a professional or commercial activity, are not permitted to create an Account or use the Service. The person creating the Account on behalf of a legal entity represents and warrants that they have the authority required to bind that entity by accepting these Terms.
3.Account and credential security
The Client is solely responsible for keeping its Credentials confidential and for any activity carried out through its Account. By accepting these Terms, the Client undertakes to:
- not use the Service fraudulently or for any purpose other than the one for which it is provided;
- take all reasonable measures to protect its Credentials against unauthorized access or attackers (strong passwords, restricted access, promptly rotating compromised Credentials, etc.);
- report to Devronium immediately any attack, attempted attack, unauthorized access, or other security breach affecting its own infrastructure that uses Brombler, as soon as it becomes aware of it.
Devronium is not liable for damages resulting from the Client's failure to comply with the obligations above.
4.Prohibited uses
Without limiting the generality of the foregoing, the Service may not be used for:
- fraudulent, deceptive or unlawful activity of any kind;
- mass telemarketing, phone or message spam, or any other form of unsolicited communication carried out at scale;
- international calls or calls to emergency services initiated through the Brombler API — these are not permitted, as a fraud-prevention measure;
- any activity that affects, disrupts or overloads the Service's infrastructure or that of other users.
Breach of any of the above restrictions may result in immediate suspension or blocking of the Account, without prior notice, and the Client will be liable for any resulting damage.
5.Service availability and limitation of liability
The Service is provided "as is" and "as available", without express or implied warranties regarding uninterrupted or error-free operation.
Although Devronium targets and typically maintains an uptime of over 99.98%, Devronium is not liable for losses, damages or costs incurred by the Client as a result of any malfunction, interruption or unavailability of the Service. Devronium is committed to treating any reported issue as a priority and to acting on it as soon as it is brought to its attention.
The Client is solely responsible for its own software, hardware and network infrastructure (equipment, internet connection, internal systems connected via the API, etc.) used to access or integrate the Service, and for any consequence arising from that infrastructure's operation or failure.
6.Fees and payment
Use of the Service is subject to the pricing plan communicated to, or agreed separately with, the Client. Devronium may periodically update its fees, with prior notice to the Client. Failure to pay amounts due on time may result in suspension of access to the Service.
7.Intellectual property
All intellectual property rights in the Service, its technology, software, trademarks and related Brombler content belong to Devronium or its licensors. These Terms do not grant the Client any ownership right in the Service, only a non-exclusive, non-transferable right of use for as long as the Account exists.
8.Personal data
Personal data processed in connection with use of the Service (including caller data, call recordings and transcripts) is processed in accordance with applicable data protection legislation. The Client is responsible for the lawfulness of collecting and transmitting to the Service the data of the individuals it interacts with through Brombler.
Devronium will not transmit this data to third parties, except to competent public authorities, and only where applicable law requires it.
9.Responsible use of artificial intelligence
Brombler uses artificial intelligence responsibly. Interaction with callers is structured around flows and rules predefined by the Client (the conversation tree and knowledge base configured for the Account), specifically to limit the risk of freely generated AI responses ("hallucinations").
Brombler provides information strictly based on what the Client makes available through the conversation tree and knowledge base associated with its Account. The Client is fully responsible for the accuracy, currency and lawfulness of this data, as well as for the content of the responses given to callers as a result of its own configuration.
10.Suspension and termination of the Account
Devronium may suspend or terminate the Client's access to the Service, in whole or in part, in the event of a breach of these Terms, including, without limitation, the situations described in Section 4. The Client may stop using the Service at any time, subject to any payment terms already in effect.
11.Changes to these Terms
Devronium may periodically update these Terms. The updated version will be published on this page, indicating the date it was last updated. Continued use of the Service after such changes are published constitutes acceptance of them.
12.Force majeure
Neither party is liable for failure to perform its obligations caused by a force majeure event, as defined under applicable Romanian law.
13.Governing law and dispute resolution
These Terms are governed by Romanian law. Any dispute arising out of or in connection with these Terms will be resolved amicably where possible, and otherwise submitted to the courts with jurisdiction over Devronium's registered office.
14.Final provisions
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect. These Terms constitute the entire agreement between the Client and Devronium regarding use of the Service, superseding any prior understanding on the same subject.
